The Seoul High Court No. 32 Civil Affairs Division held an appeal for damages on the 11th at 2.20PM. The Choi and Kim lawyers put up a fierce fight. It also turns out Choi was charged with defamation by publications and attempted fraud by the prosecutions.

Choi explained her appeal ad said, "The cost of damages went down from 1,600 million won to 700 million. In the process of the two people involved seeing and drifting far apart from each other, Kim's parents tried to manipulate her to get rid of the baby and inflicted mental illness. It was also let known to media that Kim paid 600 million won in settlement, which breaches the credit clause".

Kim stated that Choi claimed she was pregnant when she actually wasn't. Kim believed her but she'd fooled him. Then she claimed that the baby was lost due to his assault and came out strongly against him. As a celebrity figure who was about to join the military, this inflicted tremendous mental instability on him.

On this day, it came to attention that Choi was charged with defamation by publications and attempted fraud by the prosecutions. Right after the trial, Kim met with reporters and said, "It looks like the prosecutors decided Choi's action of interviewing that she'd lost the baby because of my assault and filing a claim for damages was a crime".

The justice court checked out this matter and said this damages trial needs to be proceeded according to the charges of defamation by publications and attempted fraud. The second trial will be announced later on.

Previously in August last year, Choi had pressed damage charges on Kim. In the first trial, the court ruled for Choi to give compensation of 100 million to Kim. The claim of the plaintiff and the defendant has been dismissed". Choi submitted a petition of appeal on the same month and so did Kim Hyun-joong.

Meanwhile, Choi had a son in September of 2015 and clarified that the DNA tested matched his.
